These SMS Terms and Conditions (“SMS Terms”) govern the text messaging program offered by Blackjack Express, Inc. (“Blackjack Express,” “we,” “us,” or “our”).

By opting in to receive text messages from Blackjack Express, you agree to these SMS Terms and our SMS Privacy Policy, which is available at https://www.blackjackexpress.biz/privacy/.

1. PROGRAM DESCRIPTION

The Blackjack Express SMS program provides text message communications related to our freight transportation and logistics services.

Messages may include:

  • Shipment and load-status updates;
  • Pickup and delivery information;
  • Scheduling and appointment confirmations;
  • Dispatch and carrier communications;
  • Requests for documents or shipment information;
  • Customer-service responses;
  • Account, invoice, or payment-related notifications;
  • Service announcements;
  • Responses to questions or requests; and
  • Promotional messages when you have separately consented to receive them.

The specific messages you receive will depend on your relationship and interactions with Blackjack Express.

2. HOW TO OPT IN

You may join the Blackjack Express SMS program through any of the following methods:

  • Signing customer, carrier, or vendor onboarding paperwork or a service agreement containing a distinct SMS consent authorization;
  • Providing verbal consent during a telephone conversation with our dispatch, customer service, or operations personnel; or
  • Sending a text message to a Blackjack Express telephone number.

The disclosure presented at the point of opt-in reads substantially as follows:

3. CONSENT TO RECEIVE TEXT MESSAGES

By providing your mobile telephone number and affirmatively opting in to the Blackjack Express SMS program, you authorize Blackjack Express to send text messages to the telephone number you provided.

Where applicable, messages may be sent using an automatic telephone dialing system, automated messaging platform, or similar technology.

Your consent applies only to messages from Blackjack Express. Your SMS consent will not be sold, transferred, or shared with another business for that business’s independent marketing or promotional purposes.

Consent to receive promotional text messages is not a condition of purchasing goods or services.

4. MESSAGE FREQUENCY

Message frequency varies based on:

  • Your communications with Blackjack Express;
  • Active shipments, loads, or service requests;
  • The services you have requested;
  • Operational or scheduling requirements; and
  • Your messaging preferences.

You may receive multiple messages concerning a single shipment, service request, or business transaction. Typical volume is approximately 2 to 10 messages per shipment or service request.

Blackjack Express does not guarantee that any specific number of messages will be sent.

5. MESSAGE AND DATA RATES

Message and data rates may apply according to your wireless carrier and mobile service plan.

Blackjack Express does not charge a separate fee for participating in its SMS program. You are responsible for any charges imposed by your wireless carrier, including text messaging, data, roaming, or other applicable fees.

Contact your wireless carrier for information regarding your mobile service plan.

6. OPTING OUT

You may stop receiving text messages from Blackjack Express at any time by replying STOP to a message.

You may resume receiving messages at any time by replying START or UNSTOP, or by opting in again through any of the methods described in Section 2.

You may also revoke your consent through another reasonable method that clearly communicates that you no longer wish to receive text messages from Blackjack Express.

After submitting an opt-out request, you will receive one final text message confirming that your request has been processed. The confirmation message will not contain marketing or promotional content.

Once your request has been processed, you will no longer receive messages covered by that request unless you provide consent again.

8. PRIVACY

Your participation in the Blackjack Express SMS program is also governed by our SMS Privacy Policy, which is available at https://www.blackjackexpress.biz/privacy/ and is linked from the footer of every page on www.blackjackexpress.biz.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Blackjack Express does not sell, rent, or share your mobile telephone number, SMS opt-in information, or text messaging consent with third parties or affiliates for their independent marketing or promotional purposes.

We may use vendors and service providers to operate our messaging systems and deliver text messages on our behalf. These providers may access information only as necessary to provide services to Blackjack Express.

9. ELIGIBILITY AND TELEPHONE-NUMBER RESPONSIBILITY

You must be at least 18 years of age to participate in the Blackjack Express SMS program.

By enrolling in the SMS program, you represent that:

  • You are at least 18 years of age;
  • You are the subscriber or authorized user of the mobile telephone number provided;
  • You are authorized to consent to receiving text messages at that number;
  • The information you provide is accurate and current; and
  • You will notify Blackjack Express or opt out if you stop using or controlling that telephone number.

You agree not to provide a telephone number belonging to another person without that person’s permission.

If your mobile telephone number changes or is reassigned, you are responsible for opting out of the program or notifying Blackjack Express.

10. WIRELESS-CARRIER AND DELIVERY LIMITATIONS

Text message delivery is subject to the availability and operation of your wireless carrier’s network.

Blackjack Express and participating wireless carriers do not guarantee that messages will be delivered or received within a particular timeframe. Messages may be delayed, blocked, or undelivered because of:

  • Carrier network limitations;
  • Equipment or software failures;
  • Service interruptions;
  • Telephone-number changes;
  • Device settings;
  • Internet or cellular connectivity;
  • Spam-filtering systems; or
  • Other circumstances outside Blackjack Express’s control.

Wireless carriers are not responsible for delayed or undelivered messages.

11. USER CONDUCT

You agree not to use the Blackjack Express SMS program to:

  • Send unlawful, fraudulent, threatening, abusive, or harassing communications;
  • Transmit malicious software, harmful code, or unauthorized links;
  • Impersonate another person or business;
  • Interfere with our messaging systems;
  • Attempt to gain unauthorized access to information or systems; or
  • Violate any applicable law or regulation.

Blackjack Express may suspend or terminate messaging access when it reasonably believes the program is being misused.

12. NO EMERGENCY SERVICES

The Blackjack Express SMS program is not an emergency-notification service.

Do not use SMS to report emergencies, immediate safety threats, accidents requiring emergency assistance, or other time-sensitive situations requiring an immediate response. Call 911 or the appropriate emergency service when emergency assistance is required.

Blackjack Express does not guarantee that text messages will be reviewed or answered immediately.

13. PROGRAM AVAILABILITY AND TERMINATION

Blackjack Express may modify, suspend, or discontinue all or part of its SMS program at any time.

We may also stop sending messages to a telephone number when:

  • The number appears to be invalid, inactive, or reassigned;
  • Messages are repeatedly undeliverable;
  • We receive an opt-out request;
  • Continued messaging may violate applicable law or carrier requirements;
  • The recipient misuses the program; or
  • The related service or business relationship has ended.

Termination of the SMS program does not affect rights or obligations arising before termination.

14. DISCLAIMER OF WARRANTIES

The SMS program is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Blackjack Express makes no warranty that:

  • The program will always be available;
  • Messages will be delivered without interruption or delay;
  • Message content will be free from errors;
  • Messages will be compatible with every device or carrier; or
  • The program will meet every user’s particular requirements.

Nothing in these SMS Terms excludes any warranty, right, or remedy that cannot legally be excluded.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Blackjack Express will not be responsible for indirect, incidental, special, consequential, or punitive damages resulting from:

  • Delayed or undelivered text messages;
  • Interrupted messaging services;
  • Unauthorized access to a mobile device;
  • Inaccurate information supplied by a user;
  • Carrier or network failures; or
  • A user’s failure to review or respond to a message.

This section does not limit liability that cannot legally be limited or excluded.

16. CHANGES TO THESE SMS TERMS

Blackjack Express may revise these SMS Terms periodically to reflect changes in:

  • Our messaging services;
  • Our business practices;
  • Applicable laws or regulations;
  • Wireless-carrier requirements; or
  • Messaging-platform standards.

Updated SMS Terms will be posted on our website with a revised effective date. Continued participation in the SMS program after the revised terms become effective constitutes acceptance of the revised terms, except when additional consent is required by law.

17. GOVERNING LAW

These SMS Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

Any dispute relating to these SMS Terms will be handled in a court with appropriate jurisdiction, unless Blackjack Express and the affected party agree to another lawful dispute-resolution process.
